Terms of Service
1. Overview
These Terms of Service outline the conditions under which Singwe Carriers CC provides road transport and logistics services to its clients. By engaging Singwe Carriers for any service, you agree to the terms set out below. These Terms of Service apply in addition to any specific contract or service agreement entered into between Singwe Carriers and the client.
2. Service Engagement
Services are confirmed only upon written acceptance of a quotation or the signing of a service agreement by an authorised representative of both parties. Singwe Carriers reserves the right to decline any service request at its discretion.
3. Quotations and Pricing
All quotations provided by Singwe Carriers are valid for 30 days from the date of issue unless otherwise stated in writing. Pricing is subject to change based on fluctuations in fuel costs, toll fees, exchange rates, and other operational factors. Any changes will be communicated to the client in advance where possible.
4. Client Responsibilities
The client is responsible for:
- Providing accurate and complete information regarding the nature, weight, dimensions, and value of goods to be transported
- Ensuring that all goods are adequately packaged and labelled prior to collection
- Obtaining any permits, licences, or documentation required for the transportation of specialised or regulated goods
- Ensuring that a responsible person is available at both the collection and delivery points
Singwe Carriers shall not be liable for any delays, damages, or losses resulting from the client's failure to meet these responsibilities.
5. Cargo and Liability
Singwe Carriers takes reasonable care in the handling and transportation of all cargo. However, clients are advised to ensure that their goods are covered by appropriate cargo insurance prior to transportation. Singwe Carriers' liability for loss or damage to cargo is limited to the terms outlined in any applicable written service agreement.
Singwe Carriers shall not be liable for loss or damage arising from:
- Acts of God, natural disasters, or extreme weather conditions
- Civil unrest, strikes, or government action
- Inherent defects or inadequate packaging of goods
- Delays caused by border control, customs, or third-party agencies
6. Cross-Border Shipments
For international and cross-border shipments, the client is responsible for ensuring that all required customs documentation, import/export permits, and applicable duties and taxes are in order prior to departure. Singwe Carriers will assist where possible but cannot be held responsible for delays caused by customs authorities or incomplete documentation supplied by the client.
7. Payment Terms
Payment terms are as agreed in the relevant service agreement or quotation. Late payments may attract interest in accordance with the Prescribed Rate of Interest Act, No. 55 of 1975, as amended. Singwe Carriers reserves the right to suspend services in the event of non-payment.
8. Cancellation Policy
Cancellations must be submitted in writing. Cancellations made less than 24 hours before a scheduled collection may be subject to a cancellation fee as outlined in the applicable service agreement.
9. Force Majeure
Singwe Carriers shall not be held in breach of its obligations where performance is prevented or delayed by circumstances beyond its reasonable control, including but not limited to natural disasters, government restrictions, civil unrest, or infrastructure failure.
10. Dispute Resolution
In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If no resolution is reached within 30 days, the matter shall be referred to mediation or, failing that, to the courts of the Republic of South Africa.
11. Changes to Terms of Service
Singwe Carriers reserves the right to update these Terms of Service at any time. Clients will be notified of material changes. Continued use of our services following notification constitutes acceptance of the updated terms.
